General Terms and Conditions of Sale

The website franceshuttle.com is operated by the company D TRAVEL SAS, 231 rue Saint-Honoré, 75001 Paris, France.

Article 1 – Purpose and Scope of Application

This contract applies to public non-urban road passenger transport, domestic transport, for any occasional collective service, carried out by a carrier by means of one or more coaches. The conditions under which these services are executed, in particular the applicable prices, must ensure fair remuneration of the carrier enabling coverage of the actual costs of the service provided under normal conditions of organization, safety, quality, compliance with regulations and in accordance with the provisions of law no. 82-1153 of December 30, 1982.

Article 2 – Definitions

For the purposes of this contract, the following terms mean:

” Principal” the party that enters into the transport contract with the carrier. The principal may be the beneficiary of the transport or the intermediary responsible for organizing the transport for the beneficiary;

“Carrier” the Company selected during the call for tender and with which you will be bound, regularly registered in the public road passenger transport business register;

“Passengers” the persons boarding the coach except the driver;

“Service” the occasional collective service, which involves placing a coach at the exclusive disposal of one group or multiple groups of at least ten persons.

Article 3 – Information and Documents to be Provided to the Carrier

Prior to placing the coach or coaches at the disposal of the constituted group, the principal provides the carrier in writing, or by any other means allowing for memorization, the particulars defined below.

Dates, Times and Itineraries: the date, time and place of scheduled departure and return; the route to be followed and the planned stops.

Number of Passengers: the number of passengers expected.

Nature of the Group: any particularity of the transported group.

Article 4 – Modification of the Transport Contract

Any new service or modification to the contract, requested by the principal, requires written agreement of both parties to the contract and, where applicable, an adjustment of the price. The carrier preserves passenger safety in all circumstances. If, during contract execution, a modification is requested by the principal, this request must be compatible with the carrier’s compliance with applicable safety rules regarding transport, and in particular those relating to driving time and rest periods of drivers.

Article 5 – Payment Terms

All payments are made in euros, at the time of order by credit card (Visa, Mastercard, American Express). The price includes all services defined in the transport contract. The invoice is available online in the customer portal.

The stated prices are all-inclusive and include VAT applicable at the time of order. Any change in the VAT rate may be passed on to the price of services.

Article 6 – Cancellation and Refund Conditions

Any cancellation must be notified in writing (email). The cancellation conditions are as follows:

• Cancellation more than 30 days before departure: full refund minus administrative fee (50€).

• Cancellation between 30 and 15 days before departure: 30% deduction from total amount.

• Cancellation between 14 and 7 days before departure: 50% deduction from total amount.

• Cancellation less than 7 days before departure: no refund.

Article 7 – Carrier Liability

The carrier is responsible for proper execution of the transport under the conditions defined in the contract. It is required to transport passengers to their destination, and where applicable, their luggage, under reasonable conditions of safety, comfort, hygiene and dignity. Its liability covers the transport period, that is the period during which the passenger is aboard the vehicle or in the process of boarding or disembarking.

Article 8 – Insurance

The carrier must be covered by professional liability insurance complying with applicable legal provisions. The vehicles used for transport are insured in accordance with applicable regulations.

Article 9 – Obligations of the Principal and Passengers

The principal undertakes to provide accurate and complete information upon reservation. Passengers must comply with safety instructions given by the driver and respect the agreed times. The principal is responsible for damages caused to the vehicle by passengers in the group.

Smoking in the vehicle, alcohol consumption and behavior that endangers the safety of other passengers are prohibited.

Article 10 – Complaints

Any complaint relating to the execution of the transport contract must be sent in writing to the registered office of D TRAVEL SAS, 231 rue Saint-Honoré, 75001 Paris, or by email to contact@franceshuttle.com, within 15 days following the date of transport.

Article 11 – Force Majeure

The carrier cannot be held responsible for total or partial non-performance of its obligations if this non-performance is caused by an event constituting force majeure, in particular in case of bad weather, strikes, accidents, traffic restrictions, or any other cause beyond the carrier’s control.

Article 12 – Governing Law and Disputes

These general conditions are governed by French law. In the event of dispute, the parties will endeavor to find an amicable solution. Failing that, the dispute will be brought before the competent courts of Paris.

Article 13 – Personal Data Protection

Personal data collected upon reservation are processed in accordance with the General Data Protection Regulation (GDPR). They are used exclusively for processing reservations and managing the customer relationship. You have the right to access, correct and delete your data by contacting: contact@franceshuttle.com.
